Booking Terms and Conditions – Art House Madeira

These Terms and Conditions govern reservations and stays at Art House Madeira, operated by Toada Audaz Unipessoal Lda. By making a reservation, guests acknowledge that they have read and accepted these conditions.

1. Reservations

All reservations are subject to availability and payment confirmation.

To confirm a reservation, guests must complete the payment according to the conditions applicable to the specific accommodation or booking platform.

The reservation price, cleaning fee, and any other applicable fees are those published at the time of booking.

All prices include VAT at the legal rate in force in Portugal.

2. Payment Methods

Reservations can be paid using:

  • Visa

  • Mastercard

  • American Express

Other payment methods may be available depending on the booking platform used.

3. Tourist Tax (Madeira)

According to local regulations of the Municipality of Funchal, a tourist tax (municipal tourism fee) may apply to guests staying in local accommodation establishments.

The tax is currently €2 per person per night, applicable to guests aged 13 years or older, for a maximum of 7 consecutive nights per stay.

This amount may be:

  • included in the reservation price, or

  • charged separately before or at check-in, depending on the booking platform.

The tourist tax is collected on behalf of the municipality and must be paid by the guest as required by local law.

4. Pre-Check-in and Guest Information

After completing the reservation, the booking holder will receive a confirmation email and/or SMS with information about the accommodation and optional services.

Guests may be asked to complete a Guest Registration Form (Accommodation Bulletin) before arrival. This form is required for:

  • preparation of the stay (bed linen, towels, guest services)

  • compliance with Portuguese immigration legislation regarding guest reporting.

The form may request:

  • arrival time

  • number of guests staying in the accommodation

  • identification details required by Portuguese authorities

The number of guests staying at the property must not exceed the number indicated in the reservation.

If the maximum capacity is exceeded, Art House Madeira reserves the right to terminate the stay without refund.

Providing false or incomplete information may result in reservation cancellation.

5. Guest Reporting Obligations (AIMA / SEF)

Under Portuguese law and the Schengen Convention (Article 45), all accommodation providers must report the stay of foreign guests to the national immigration authorities.

For this purpose, guests must provide valid identification information (passport or ID) before or at check-in.

This information is transmitted through the official guest reporting system managed by AIMA (formerly SEF).

6. Cancellation Policy

Unless otherwise specified at the time of booking, the following cancellation policy applies:

  • Cancellation up to 15 days before check-in: 50% of the total reservation amount will be charged.

  • Cancellation less than 15 days before check-in: 100% of the total reservation amount will be charged.

Specific cancellation policies may apply when booking through external platforms such as Airbnb or Booking.com, in which case the platform’s rules will prevail.

7. Overbooking Situations

In the unlikely event of an overbooking or unforeseen unavailability of the reserved accommodation, Art House Madeira may relocate guests to accommodation of equivalent or higher standard, at no additional cost.

If relocation is not possible or accepted, the reservation amount will be refunded. No additional compensation will be due.

8. Stay Conditions

The reservation holder must:

  • be at least 18 years old

  • stay in the accommodation during the entire reservation period

Guests under 18 may only stay when accompanied by a responsible adult.

The reservation holder must provide valid contact details, including telephone number and email address.

Smoking

Smoking is strictly prohibited inside the accommodation.

Pets

Unless explicitly authorised in advance, pets are not allowed in the accommodation.

Failure to comply with these rules may result in immediate termination of the stay without refund.

9. Check-in and Check-out

Check-in

Standard check-in time: 16:00 – 22:00

Guests may be required to present valid identification documents upon arrival.

Late check-ins may be available subject to prior confirmation.

If a physical check-in is required after 22:00, a €30 late check-in fee may apply.

Self check-in may be available when the Guest Registration Form is completed in advance.

Check-out

Check-out time: until 11:00

Guests must vacate the accommodation and return the keys by the agreed time.

If a staff member cannot be present, guests may leave the keys inside the accommodation on the main table and close the door.

Keys must not be left in the lock or outside the property.

Late departures without prior approval may result in additional charges equivalent to one night's stay.

10. Keys and Lockouts

Guests receive one set of keys at check-in.

Fees may apply in the following situations:

  • Lost key: €30 per key

  • Emergency visit (09:00 – 18:00): €10

  • Emergency visit (18:00 – 09:00): €25

If a locksmith service is required, the guest will be responsible for the full cost charged by the service provider.

11. Cleaning, Linen and Towels

The accommodation is professionally cleaned before arrival.

Each reservation includes:

  • bed linen

  • bath towels

  • basic toiletries

Additional cleaning services or linen changes may be requested for an additional fee.

Guests are expected to leave the accommodation in a reasonable state of cleanliness.

Trash must be disposed of in public street containers and not left inside or outside the building.

12. Equipment and Property

All furniture, equipment, and items inside the accommodation belong to the property owner.

Guests must:

  • use equipment responsibly

  • not remove or relocate items

  • report any malfunction or damage

Any damages must be reported immediately.

Failure to report damages may result in liability for repair costs.

13. Maintenance and Access

If technical issues arise (e.g., water leaks, electrical problems), guests must notify Art House Madeira immediately.

While respecting guest privacy, the property manager reserves the right to access the accommodation when necessary for maintenance, inspections, or emergencies.

14. Noise and Behaviour

According to Portuguese law, the night-time quiet period runs from 22:00 to 08:00.

Guests must respect neighbors and avoid excessive noise.

Illegal or immoral activities are strictly prohibited.

The reservation holder is responsible for the behaviour of all members of the group.

15. Guest Safety

Guests are responsible for their own safety during the stay.

When leaving the accommodation, guests should ensure that:

  • gas appliances are turned off

  • lights and air conditioning are switched off

  • windows and doors are closed

Any safety concerns should be reported immediately.

16. Liability

Art House Madeira is responsible for the accommodation itself but cannot be held liable for circumstances beyond its control, including:

  • building maintenance issues

  • construction noise in surrounding areas

  • interruptions in utilities (water, electricity, internet, gas)

  • actions of third parties

Photos and descriptions of the accommodation are provided for information purposes. Minor differences may occur.

17. Lost Items

Art House Madeira is not responsible for items left in the accommodation after departure.

If belongings are found, they may be returned upon request. Shipping and handling costs are the responsibility of the guest.

18. Force Majeure

In rare cases where the accommodation becomes unavailable due to circumstances beyond the control of the operator (such as water damage or technical failures), guests may be relocated to similar accommodation, when possible.

If relocation is not possible, the unused portion of the reservation will be refunded.

19. Amendments

Art House Madeira reserves the right to update these Terms and Conditions whenever necessary.

The latest version will always be available to guests before confirming a reservation.

20. Applicable Law

These Terms and Conditions are governed by Portuguese law.

Any disputes arising from reservations or stays shall be subject to the jurisdiction of the Portuguese courts.
